Introduction

These Terms of Use (“Terms”) govern your access to and use of ullltradesign.com and all services offered under the UltraDesign brand (together, “the Service”). The Service is operated by NEXARYON LIMITED (company number 17148886), with registered office at Studio No. 19, 138 Marylebone Road, London NW1 5PH, United Kingdom. By using the Service you agree to these Terms.

Eligibility and account

You must be at least 18 years old to create an account. You are responsible for the accuracy of the information you provide and for all activity under your account. Keep your credentials confidential.

What we sell

The Service offers digital goods: 3D models, icon packs, and graphic packs. All items are delivered electronically. Nothing physical is shipped.

Orders and payment

Prices are shown in the currency indicated at checkout and include VAT where applicable. An order becomes a binding contract when we issue an order confirmation and make the files available for download. Payments are taken by our payment service providers; we do not store full card details.

Use of purchased files

Your use of any downloaded file is governed by our License Agreement, which forms part of these Terms. In the event of conflict, the License Agreement prevails for matters of use rights.

Acceptable use

You must not: attempt to disrupt or probe the Service; use automated scrapers or bots other than as expressly permitted; resell, rent, or share your account; upload unlawful content via any form on the Service; circumvent access controls; or infringe the rights of others.

Intellectual property of the Service

The UltraDesign name, logo, site design, copy, and curated arrangement of listings are owned by us and protected by UK and international intellectual property laws.

Availability and changes

We may modify or suspend any part of the Service at any time. We will make reasonable efforts to give notice of material changes. We may update these Terms from time to time; the “last updated” date shows when the current version took effect.

Liability

To the extent permitted by law, our total liability arising out of or related to the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.

Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, without prejudice to your mandatory consumer rights.

Chargebacks

A chargeback is a payment dispute initiated by a customer through their bank or card issuer. Because UltraDesign sells digital goods that are delivered immediately upon order completion, chargebacks are treated as follows.

Before filing a chargeback, you must first contact us at info@ullltradesign.com and allow us up to seven (7) business days to resolve the issue.

Dispute timeframe. Any chargeback must be initiated within thirty (30) days of the transaction date. Disputes filed outside this period may be rejected by the acquiring bank.

Unjustified chargebacks. If a chargeback is filed without prior contact with us or is determined to be unjustified (for example, the digital product was successfully delivered and downloaded), we reserve the right to provide the acquirer with evidence of digital fulfillment (download logs, IP address and timestamps), permanently suspend the associated user account, and recover any fees, costs or damages incurred as a result, including a chargeback handling fee of up to EUR 25 per incident, in accordance with applicable law.

Fraudulent chargebacks. Filing a chargeback with intent to defraud (so-called “friendly fraud”) may be reported to the card network, the issuing bank and, where appropriate, to the competent authorities. UltraDesign cooperates fully with chargeback-fraud investigations and supports prosecution where lawful.

Prices and Currencies

All prices on UltraDesign are displayed in Euro (EUR) and are inclusive of any applicable indirect taxes (such as VAT) where required by law. Your card issuer may apply a foreign-exchange conversion if your account is denominated in a different currency; UltraDesign is not responsible for such conversions or fees.

Prices may be updated from time to time. The price applicable to your order is the price displayed at the moment of checkout.

Restricted and Sanctioned Jurisdictions

UltraDesign complies with applicable UK, EU and US trade-and-financial sanctions regimes. Our services are not available, and may not be accessed or used, in or by any person located in, ordinarily resident in, or incorporated under the laws of any of the following territories:

  • Cuba;
  • Iran;
  • The Crimea, Donetsk and Luhansk regions of Ukraine;
  • North Korea (Democratic People’s Republic of Korea);
  • Russia;
  • Syria;
  • Belarus;
  • Any other country or region subject to comprehensive UK, EU or US sanctions from time to time.

You represent and warrant that you are not located in, a resident of, or otherwise subject to the jurisdiction of any of the above territories, and that you are not listed on, or acting on behalf of any person listed on, any applicable sanctions list. If we determine that you are in breach of this section, we may immediately suspend or terminate your account and refuse or reverse any transaction.

Chargebacks and Payment Disputes

By completing a purchase on UltraDesign, you agree to contact our support team at info@ullltradesign.com before initiating any chargeback or dispute with your card issuer. Most issues — failed downloads, billing errors, duplicate charges — can be resolved within 24-48 hours through our support channel.

NEXARYON LIMITED reserves the right to challenge invalid chargebacks with the following evidence: order confirmation timestamp, IP address used at checkout, download logs proving access to the digital file, and email correspondence. Repeat or fraudulent chargebacks may result in account suspension, banning, and reporting to acquirer fraud-prevention databases.

Prices and Currencies

All prices on UltraDesign are displayed in USD (the default settlement currency) unless explicitly stated otherwise. Where a currency switcher is available on the storefront, alternative currencies are shown as a convenience for customers; the actual transaction is processed in USD and your card issuer may apply currency-conversion fees on your statement.

Prices may be updated without notice. The price displayed at the moment you confirm checkout is binding for that order; we do not retroactively price-match earlier or later quotes. Promotional discounts and coupons are applied only when entered before final order submission.

Where applicable, indirect taxes (VAT in the United Kingdom and European Union, sales tax in jurisdictions where we are registered) are calculated automatically at checkout based on your billing address. Tax-inclusive vs tax-exclusive display is governed by your billing country.

NEXARYON LIMITED is not responsible for additional fees imposed by your bank, card issuer, or local payment regulator beyond the transaction amount confirmed at checkout.

Sanctioned Jurisdictions and Restricted Persons

By using UltraDesign, you confirm that you are not located in, a resident of, or accessing the Service from any of the following countries or regions, in line with United Kingdom (HM Treasury), European Union (Common Foreign and Security Policy), and United States (OFAC) sanctions regulations:

  • Cuba
  • Iran (Islamic Republic of)
  • North Korea (Democratic People’s Republic of Korea, DPRK)
  • Syria
  • Crimea, Donetsk People’s Republic (DNR), and Luhansk People’s Republic (LNR) regions of Ukraine
  • Any other country or region currently designated by HM Treasury, the EU, or OFAC as a comprehensively sanctioned territory.

You also confirm that you are not on any government list of sanctioned individuals or entities, including the UK Consolidated List, the EU Consolidated List, the US OFAC Specially Designated Nationals (SDN) list, or any equivalent sanctions list. NEXARYON LIMITED reserves the right to refuse, cancel, or refund any order found to violate these sanctions, and to report such activity to relevant national authorities.
